CAT UPDATE


THE NEXT HEARING OF OUR CASE IS POSTED TO 18-1-2017 AT CAT,ERNAKULAM.  DOPT HAS ALREADY SUBMITTED THEIR REPLY STATEMENT AND  OUR ADVOCATE PREPARED COUNTER.  HOPE THAT WITHIN ONE OR TWO HEARING THE CASE WILL BE FINALISED.

CAT case update


Dear Members,

                      Due to  some reasons the CAT case update could not be posted.  The DOPT submitted counter reply and  our advocate is finalising the reply. Our  senior members Shri.Srinivasan PS to Commissioner,Income Tax   and Shri.Sivakumar  PS in   Passport, Kochi met  our Advocate and elaborately discussed the the counter  reply and ammendments to be made in the reply to be submitted to CAT.  Based on that our ADVOCATE will finalise the reply and will file to CAT within next week.

Subject:- Procedure for booking of air-tickets on LTC – clarification reg.
The undersigned is directed to refer to this Department’s O.M. of even no. dated 23.09.2015 on the subject noted above and to say that as per the extant instructions, whenever a Government servant claims LTC by air, he/she is required to book the air tickets directly from the airlines (Booking counters, website of airlines) or by utilizing the services of the authorized travel agents viz. ‘M/s Balmer Lawrie & Company’, ‘M/s Ashok Travels & Tours’ and ‘IRCTC’ (to the extent IRCTC is authorized as per DoPT O.M. No. 31011/6/2002-Est(A) dated 02.12.2009) while undertaking LTC journey(s).

2. In this regard, references are received in this Department seeking clarification whether the aforesaid condition of booking the tickets through authorized travel agents needs to be followed in cases where a non-entitled Government servant travels by air on LTC and claims the entitled train fare.
3. The matter has been examined in consultation with Department of Expenditure, Ministry of Finance and it is hereby clarified that in case of non-entitled Government servants travelling by air on LTC and claiming entitled rail fare, the condition of booking the air tickets through authorised travel agents viz. ‘M/s Balmer Lawrie & Company’, ‘M/s Ashok Travels & Tours’ and ‘IRCTC’ may not be insisted upon. In rest of the cases, the condition of booking the tickets through authorised modes shall continue to follow.

DoPT denies Media News about extension of working hours of Central Government employees 

The attention is drawn to the media news about extension of working hours of Central Government employees by the Department of Personnel and Training (DoPT), Ministry of Personnel, Public Grievances and Pensions, Government of India. It has been stated in the news item that Central Government employees’ working hours will be changed from 09.00 AM to 07.00 PM. It was also stated that the holiday of Saturday will also be done away with for the Central Government employees.

In this regard, the DoPT clarifies that there is no such proposal under consideration of the Central Government. The media news regarding the extension of working hours and abolition of holiday on Saturday for Central Government employees is false and baseless. There is no oral or unwritten order issued in this regard.

CAT UPDATE

Dear members,        Our CAT case hearing held during March and the CAT Ernakulam fined Rs 5000/_ to DOPT for not submitting  replacement statement  and directed DOPT  to submit reply before next hearing ie , on 16.05.2017,  else fine will be impossed on th3 officer at fault.   Let us hope for the best

CAT Update


Our  parity case heard on  17-2-2017 at CAT, Ernakulam.  As no reply submitted by the DOPT, the CAT strongly criticized the  Government counsel and directed to submit reply, if any by 15th March 2017 else huge fine will be impossed or exparte decision will be taken. Next hearing will be held on 30-3-2017.

 Our parity case hearing held today.  The DOPT failed to submit the  reply statement.  Our advocate argued and submitted not to grant further time.  However, CAT gave last chance of 2 weeks time.
