CAT Update

         RELIEF (S) SOUGHT
In view of the facts mentioned above the applicants pray for the following reliefs:

(i)           To declare that applicants working as Stenographers in various grades with different Departments under the Central Government are entitled to pay parity with their counter parts in Central Secretariat Stenographers Service being enjoyed decades together.

(ii)             To direct the respondents to grant Non Functional Selection Grade (NFSG) of Rs.4200/- to Stenographer (Gr.II) [erstwhile Stenographer (Gr.III)] of subordinate offices w.e.f. 22.06.2011 with consequential benefits, on par with their counterparts of CSSS.

iii)        To direct the respondents to grant upgraded pay scale of Rs.6500-10500 w.e.f. 15.9.2006  and Grade Pay of Rs.4600 w.e.f. 1.1.2006 to the Stenographers-Gr.1 of subordinate offices with consequential benefits, on par with their counterparts of CSSS.
iv)       To direct the respondents to grant non-functional pay scale of Rs.8000-13500 w.e.f. 2.10.2003 to the Private Secretaries of subordinate offices with consequential benefits, on par with their counterparts of CSSS.
v)        To direct the respondents to grant Grade Pay of Rs.4800 in PB 2 w.e.f. 1.1.2006 and Non-Functional Pay Scale of PB 3 with Grade Pay of Rs.5400 to the Private Secretaries of subordinate offices w.e.f. 1.1.2006 in terms of 6th CPC with consequential benefits, on par with their counterparts of CSSS.

vi)       To Grant such other reliefs as are deemed fit, just, fair and reasonable in the facts and circumstances of the case, including consequential benefits with cost of the litigation and the interest @ 18% per annum on the delayed payments from the date(s) on which the aforesaid relief becomes due.

  1. Prayer is OK and covered all stenographers. One point always in my mind is that stenographers of Subordinate /field offices represented by Confederation has demanding parity of pay scales with their counterparts in central secretariat from time to time. The matter was raised in JCM and in view of disagreement, it was referred to a Board of Arbitration on 4.8.1986. In the meantime 4th Central Pay Commission recommended common scales of pay in respect of stenographer grade iii/D (Rs. 1200-2040) whereas the Commission recommended Rs.1400-2300 for stenographer grade ii of Subordinate /attached offices and Rs. 1400-2600 for stenographer grade C of central secretariat. The board of arbitration after taking into account of the stands of either side announced its award on 18.8.1989 in terms of which stenographers of Subordinate /attached offices in the existing scale of pay of Rs. 1400 -2300 were directed to be placed in the pay scale of Rs. 1400-2600. However, Government of India unilaterally on the basis of a CAT order without recommendation of any Commission or Board of Arbitration revised the scale of Rs.1400-2600 to Rs. 1640-2900 in respect of stenographer grade C of central secretariat with retrospective effect from 1.1.1986.Thus violated award dated 18.8.1989 passed by the Board of Arbitration. The 6th central pay commission recommendations for parity of pay upto the level of Assistants also not implemented so far. Award passed by Board of Arbitration can be rejected by the Parliament level only as per JCM scheme. Hostile attitude of some functionaries should be pointed out in affidavit or oral hearing.

Another suggestion to our relief is to quash or set aside Ministry of Finance OM dated 13th November 2009 in relation to pay scales of Private Secretary(Rs. 6500-10500) of Subordinate / attached field offices to Grade Pay of Rs. 4600 as due to introducing of this Grade Pay 4600 without any specific recommendations in 6th CPC all Private Secretary who completed 30 years are only getting Grade Pay of Rs 4800 in 3rd ACP instead of Grade Pay of Rs 5400. In fact 6th CPC recommended four tier scale structure of stenographers viz. Grade Pay Rs. 2400, 4200, 4800 and 5400. As per hierarchy of cadre those who completed 24 years before 31.8.2008 are to get 2nd ACP in Grade Pay of Rs 4800 and on completion 30 years to get Grade Pay of Rs 5400 if Grade Pay of Rs 4600 was not introduced . But due to introducing of Grade Pay of Rs 4600 Private Secretary could not get Grade Pay of Rs 5400 in their life. It says in OM dated 13.11.2009 that this Grade Pay of Rs 4600 is introduced on demand of National Council of JCM. Due to this demand stenographers or PS who got 2nd ACP in Grade Pay of Rs 4800 immediately after introduction of 6th CPC are degraded to Grade Pay of Rs 4600 from 13.11.2009 and consequently in 3rd MACP only Grade Pay of Rs 4800 only. Hence, if we could quash OM dated 13.11.2009 many Grade ii, I as well as PS who completed 24 years service on or before 31.8.2008 could get Grade Pay of Rs 5400 in 3rd MACP. Since there is little or nill posts of SrPS in field offices quash of OM dated 13.11.2009 will benefit many stenographers.
